Lawsuits Filed In Kwiatkowski Hepatitis C Contamination Nightmare
Two lawsuits, one as a class action and one by an individual plaintiff, have been filed against Triage Staffing, Inc., the staffing company which placed David Kwiatkowski, a cardiac catheterization lab technician, in various hospitals around the country. Kwiatkowski, who was infected with Hepatitis C, has been arrested and charged after it was alleged that on multiple occasions he stole IV narcotics, injected them into himself, and then returned the syringe which he filled with another liquid (i.e water or saline), which was then injected into a patient transmitting the virus. At least 30 patients have been identified as contracting Hepatitis C as a result and thousands more were potentially exposed in 8 states.
In Fowler v Triage Staffing, Inc. the single plaintiff alleges that Kwiatkowski was involved in a suspected drug diversion incident in 2008, and specifically:
